All New Highs And Lows

 

Hello Readers!!

                       How are you all doing? All happy and healthy I Hope!

As mentioned in last months newsletter:- My attempts to improve the first articles listed on this sites Home page, navigation (index)are the updated-Re-written articles:-

Last month, did you click on:- “OAK- HE’S MY STRENGTH” and check out the latest photos of Oak our son?

Shit!! He don’t look that much smaller than his mother “Lek”, and yet he aint 5 years old, He’s gonna be a big chap!!

I can’t believe just how quickly and so much he has grown in the 8 months since I last saw him.

Shit!!, he’s a handsome and all so cute and not so little chap anymore!

God I love him to bits and miss him and Lek Terribly!!

8 long months have passed since I left Thailand.

November 2nd 2007, a Friday the last time and prison visit with them both.

It feels like a life time ago!!

My one/two monthly telephone calls to them are no where near sufficient and do very little to close the massive gap of thousand of miles. At £3.00 a minute our calls as infrequent as they are, are also all so very short.

My £15.00 (yes fifteen pounds) prison weekly wage, after paying for my legal calls, buying essential toiletries etc. leaves little for keeping close ties with my wife and son.

Absence sure makes the heart grow fonder though!!

My mother and father, bless them! Make weekly calls to Lek and Oak, and I send lots of greeting cards with short messages, declaring my love and how much I miss them both.

We do what we can to bridge those thousands of miles.

 

Okay Readers!! Updates on last month’s newsletter:-

Starting as always in chronological order of the months events:-

9th July, we receive confirmation that the full hearing for my Judicial Review of the enforcement of my sentence will be heard at the High Court, London on Thursday 31st July 2008

WOW Incredible News!! At last my case is to be heard!!

 

11th July, it all comes crashing down!!

As you all know from April 2008 newsletter (April 17th 2008 to be exact), I was granted permission for a full hearing, (or so we all thought) in respect of my Judicial Review.

Usually in cases of Judicial Review, once you have passed the permission stage your case automatically progresses to a full hearing.

All parties believed this happened in my case (in April)

However, upon reading the letter from the High Court it appears my case has been listed on 31st July for an oral permission hearing and not the full hearing we all thought.

Unfortunately, when we received the notice of permission in April, this was not made clear by the court, especially as it was an unusual course for my case to follow.

It is now confirmed my case has been listed for effectively an additional permission hearing which will be an oral hearing, as opposed to the first hearing when the Judge considered my case on paper.

Shit!! Shit!! Shit!! What a massive set back!!

Crushed I am!!

Oh Well!! Back to where we were before and again we still have a huge hurdle to overcome.

(I can’t believe it!!! What an incredible mix up)

 

It’s a Roller Coaster and a half this month readers!!

Okay onto my wife (Lek) news, remember the “New visiting visa which she had refused in may 2008, well we’ve now also lodged a new appeal to the Immigration Tribunal in relation to the appeal against the refusal of that Visit visa. The tribunal directs that the British Embassy Visa section Thailand has until 15th September 2008 to file their case against us. So Lek now has two appeals lodged to two separate visas (this new visiting visa) and her ongoing and now numerous appeals against her (settlement visa) refusals.

 

Confused?

You should be!! With Lek’s two appeals and my appeal!!

 

Hang onto your seats:- Now the Roller Coaster is going to all too new highs.

 

Remember Lek’s settlement visa appeal which took place on 21st May 2008, and the Judge reserved her determination.

 

15th July 2008, THE MOST AMAZING NEWS ARRIVES !!

 

WE WON!! WE WON!! WE FINALLY DID IT!!

 

I’ am so so so HAPPY, DELIGHTED to tell you all that my wife Lek reconsideration hearing (appeal) which was heard on 21st May 2008 has been allowed.

This is just the happiest news ever!!!

I can’t put into words just how happy I and our family are right now, such relief!!!

Over a year has passed since the first application was made and refused, and also numerous appeals also refused. We’ve done it!! Leks settlement visa which allows for a 2years stay in England has been granted by the appeal court judge.

It just shows you readers!! You should never give up a cause that is right, never lay down and be counted.

I will be honest readers, I was starting to crack!! And have serious doubts we would ever be successful, after a series of failed appeals.

But we never stopped fighting!!!

 

So so many people have contributed on all different levels of help in making this appeal successful, too many to list and thank you all personally.

“With all our hearts we all thank you so much”

You’ve all played a very important part in the soon to be reunion of our family.

 

A few special mentions though!

 

Mum and dad, you’ve both been fantastic throughout and your sacrifice and commitment to both Lek and Oak is second to none (“you’re the best”)

Carla as always your way way beyond a simple thank you and you are by far the most instrumental in this team success on both a legal side and friendship.

Farin Anthony (Solicitor) of French and Company, Nottingham, Mrs. Usha Sood (barrister) of Trent, Chambers, Nottingham, you both went way beyond the call of duty to us, thank you so much!!

Without wanting to put a damper on this fantastic news:-

Although we’ve won this appeal, the Home Office does now have 10 working days in which they can appeal the decision (our win).

This is rather unlikely that they will appeal this decision.

The right of appeal would be to the Court of Appeal, and when it gets to this stage and where the Home Office have lost, they very seldom appeal such decisions, unless the case could set legal precedent.

What will happen now is that once the Home Office have “HOPEFULLY” decided that they will not appeal the decision, they will inform the British Embassy in Thailand, who will then call my wife to attend the Embassy for her Passport to be endorsed with her visa and she can then travel to England.

The whole process normally takes about 6 weeks from the end of the 10 working days that the Home Office has to appeal the decision.

 

We are almost there readers!!

 

According to our solicitors calculations the Home Office have until 30th July (the 10 working days) in which to lodge their appeal by, plus 2 more days for deemed date of receipt. Therefore Monday next month (4th August) would be the earliest date we can check with the tribunal as to whether they have appealed.

 

The waiting game continues!! See next month newsletter for confirmation. “Fingers crossed readers”, it’s all concluded and the happy ending we’ve all worked long and hard for is realized.

 

Last but not least:-

 

31st July my Judicial review appeal (oral permission hearing)

 

Hold your breath readers!!

 

The appeal was concluded!!

No Judges reserved determination this time.

 

Shit!!, what a month we are having!!

 

I am pleased…NO ECSTATIC!! To confirm readers… that permission for a full hearing in respect of my judicial review of the enforcement of my Thai sentence was granted.

 

YES!!, YES!!, YES!!, YET ANOTHER WIN!!

 

The full hearing in the High Court is now definite.

No hearing date for the full hearing has been fixed yet! What a remarkable month this has turned out to be.

Two out of two wins, I am (we are) over the moon.

Carla and Max Duddles of Moss Solicitors and Mr John Jones (Barrister) of Doughty Street Chambers, you’ve all been fantastic, thanks for keeping my hopes and dreams alive.

 

Light a few candles, say a few prayers, do whatever you do to influence the Home Office into not appealing Leks settlement visa appeal win.
