D – DAY that’s how my mother announced July 1st to me “Judgment Day”

Not good news my friends I am sorry to say.

APPEAL REFUSED !!

To be honest I’ve always expected a Refusal at this stage, the main battle grounds are yet to come! Sure we are very disappointed as the longer the reserved decision on the Judgment went, the more a little light of hope grew and like you all we hoped a common sense of Justice would prevail. But it’s not clear cut as it would seem, trust me! This Judgment now gives us the answers to where we need to better our arguments and explain more clearly our position and I believe the solutions to this problem. Much was misunderstood and misinterpreted, no fault of the Judges or our Legal Team who did a fantastic Job.

Okay!. What’s the next step, well two options remain an appeal to the House of Lords and an appeal to the European Court of Human Rights one at a time and in the order of the above.

You must get leave granted at either courts for an appeal and you must I believe exhaust every avenue possible in the UK before going to the European Court. The House of Lords being our last avenue, so even if leave to appeal there is refused it only hastens our appeal to the European Court.

The European Court of Human Rights has always been our destination.

Simply put this lost appeal we see as just one stepping stone to get across the river. We are now another stone closer to getting to the far bank.

Mr. Justice Ouseley special thanks to you for your detailed and precise Judgment. Mr. Justice Davis also your contributions most welcome and thank you. Our position is now much clearer all credit to you both for the tremendous amount of work you put into this Judgment. I mean that sincerely, many a Judge would have dismissed our appeal with a one or few page dismissal.

 

Carla thank you for the beautiful card and the smile it gave me. The card is indeed on my wall to remind me and encourage me.

 

Tom Morrison I much appreciated your letter and hope you don’t mind me quoting a few lines here:-

‘Hi Steve,

              Been meaning to write to you for months and months sorry mate, I’ve had a traumatic eighteen months which we won’t dwell on now.

I heard on the radio about your appeal yesterday so I know you must be feeling down mate, so I am writing this to let you know your always in my thoughts every day even though I’ve not been in touch.

So many positive things have happened since I saw you, it must be great to have Lek and Oak in England. So try to stay positive Steve I’ve drawn my strength over the last 18 months from knowing that you handle your situation, so my problems are nothing really.

I hope this is one of many letters you receive at this disappointing time,
